Employees follow the work schedule of the client company, have their workplaces on the territory of the client company, but receive wages from the provider company. In other words, labor relations (employer-employee) take place in a company that provides outstaffing services.

The task of the provider is to establish relations with the employee on pre-arranged terms and further manage his personnel and accounting administration. An employment contract is concluded between the provider company and each employee (both temporary, i.e. only for the term of the contract on the provision of personnel services to the customer, and for an indefinite period — if it is planned that the specialist will be constantly provided with work for different customers).

The legislation does not define the term «outstaffing», but it provides such a type of activity as «the activity of economic entities that hire employees for their further performance of work for another employer», which is the same concept as outstaffing.
Also, the legislation contains a definition of staffing service, namely: staffing service is an economic or civil law contract, according to which the person providing the service (resident or non-resident) places at the disposal of another person (resident or non-resident) one or more natural persons to perform the functions defined by such an agreement.
The contract for the provision of personnel may include the conclusion of an employment agreement or an employment contract by the specified individuals with the person at whose disposal they are sent. Other conditions for providing personnel (in particular, the remuneration of the person providing the service) are determined by the contract between the parties.
